결혼이민(F-6) 체류기간 연장 준비

자격 해당자 — 한국에서 혼인이 유효하게 성립되어 있고 우리 국민과 결혼생활을 지속하기 위해 국내 체류를 하고자 하는 사람, 국민과 혼인관계(사실상의 혼인관계 포함)에서 출생한 자녀를 양육하고 있는 부 또는 모로서 법무부장관이 인정하는 사람, 국민인 배우자와 혼인한 상태로 국내에 체류하던 중 그 배우자의 사망이나 실종, 그 밖에 자신에게 책임이 없는 사유로 정상적인 혼인관계를 유지할 수 없는 사람으로서 법무부장관이 인정하는 사람이에요.Who holds this status — a person whose marriage is validly formed in Korea and who wishes to stay in Korea to continue married life with a Korean national; a father or mother recognised by the Minister of Justice who is raising a child born of a marital relationship (including de facto marriage) with a Korean national; and a person recognised by the Minister of Justice who, while staying in Korea married to a Korean spouse, cannot maintain a normal marital relationship due to the spouse's death or disappearance or other causes not attributable to that person.

사실혼은 주관적으로 혼인의 의사가 있고, 객관적으로는 사회통념상 가족질서의 면에서 부부공동생활을 인정할 만한 실체가 있는 경우에 성립해요(대법원 98므961, 1998.12.08). 혼인의사 없이 단순 동거를 한 경우, 법률상 보호를 받을 수 없는 중혼적 사실혼 관계인 경우에는 사실혼 관계로 볼 수 없어요.A de facto marriage exists where there is subjectively an intent to marry and objectively the substance of a marital household recognised by social norms of family order (Supreme Court 98Meu961, 8 Dec 1998). Mere cohabitation without marital intent, or a bigamous de facto relationship that cannot be legally protected, does not count.

체류자격 세부약호 — F-6-1은 양 당사자 국가에 혼인이 유효하게 성립되어 있고 우리 국민과 결혼생활을 지속하기 위해 국내 체류를 하고자 하는 외국인, F-6-2는 국민과 혼인관계(사실상의 혼인관계를 포함)에서 출생한 미성년 자녀를 혼인관계 단절 후 국내에서 양육하거나 양육하려는 부 또는 모, F-6-3은 국민인 배우자와 혼인한 상태로 국내에 체류하던 중 그 배우자의 사망·실종, 그 밖에 자신에게 책임이 없는 사유로 정상적인 혼인관계를 유지할 수 없는 사람이에요.Sub-categories — F-6-1: a foreign national whose marriage is validly formed in both countries and who wishes to stay in Korea to continue married life with a Korean national; F-6-2: a father or mother raising, or intending to raise, in Korea after the marital relationship ended, a minor child born of a marital relationship (including de facto marriage) with a Korean national; F-6-3: a person who, while staying in Korea married to a Korean spouse, cannot maintain a normal marital relationship due to the spouse's death or disappearance or other causes not attributable to that person.
